Understanding the impact of EU law on tech markets with Mikołaj Barczentewicz

My credentials: I am an academic lawyer, but my career started in tech. I taught myself to code as a teenager and worked in the web industry for several years. Now, I am an Associate Professor of Law at the University of Surrey and a Research Associate at the University of Oxford, where I received my doctorate. I’m also a Senior Scholar at the International Center for Law & Economics. Aside from research and teaching, I help capital allocators and technology businesses understand how EU law can affect tech markets.

Focus areas: I focus especially on privacy, AI, and the regulation of large online platforms, but I also cover other aspects of EU tech law. Accronyms of interest include the GDPR, the DSA, the DMA, and many others.

Manifesto: the need for rules in the growing digital world is clear, but rushing to create them without careful thought leads to problems. The challenges brought by technology are varied and need a balanced, informed discussion. I aim to spark thoughtful conversations about these issues, looking closely at the relationship between technology and law, with an eye towards a future where innovation flourishes under sensible regulation.

At the heart of my exploration lies digital constitutionalism—a framework examining how constitutional law and fundamental rights operate within our evolving digital landscape. As we navigate digital regulation, preserving constitutional principles is essential. Beyond merely reconciling law with technology, we must construct a digital ecosystem where fundamental rights flourish and constitutional values guide governance.
